More than a year and a half after the indictment took place in the district court Würzburg the trial against the AfD politician Daniel Halemba started. The member of the state parliament initially did not personally comment on the public prosecutor’s allegations. A few minutes before the trial began, he protested his innocence to journalists.

After the indictment was read out, two of his three lawyers spoke up, but they did not make any specific statements about the allegations. The public prosecutor’s office accuses the Bavarian member of the state parliament of sedition, money laundering, damage to property, coercion and attempted coercion.

Suspected intimidation and money laundering

Loud Public Prosecutor’s Office A song by a neo-Nazi band is also said to have been played at Halemba’s birthday party in July 2022, inciting hatred against the Turkish population living in Germany. Halemba is also said to have intimidated a witness in the investigation against him.

The authorities also accuse the 24-year-old of having transferred a mid-four-digit amount of money from his private account to an account in the Baltics. The money is said to have come from third-party fraud, and Halemba is said to have received a commission for the transfer. The accusation is money laundering.

Lawyer and possibly injured party

In addition to Halemba, another man is charged. Together with the 24-year-old, he is said to have threatened, among other things, a lawyer and damaged the door of his office. Particularly complicated: The lawyer, Thomas Bayer, is an AfD member like the defendants. He represents the co-defendant in court, but at the same time he may also be an injured party.

Bayer said in court that his client did not commit the property damage. “It wasn’t him. My client and that Members of the state parliament Halemba were at the door,” said the defense attorney about the incident in May 2023. He doesn’t know who exactly knocked on the door because he couldn’t see it from the inside. Bayer therefore called for the proceedings to be stopped.

The trial takes place before the youth jury court

The youth chamber has scheduled a total of eight days of negotiations until January 29th. The trial is taking place before a youth jury court because Halemba was still subject to juvenile criminal law for some of the alleged actions due to his age at the time.
